The recently enacted federal tax reform legislation includes an important provision—the "Investing in Opportunity Act"—that creates a new capital gains incentive for private investment into low income urban and rural communities around the country. The new law establishes an "Opportunity Zone" program, which allows private investors to re-invest their unrealized capital gains into "Opportunity Funds" in exchange for a tax deferral and other benefits tied to long-term holdings in designated low-income communities. The program has the potential to catalyze billions of dollars of private investment into these communities and represents the most significant federal community development tool since the New Markets Tax Credit and the Low-Income Housing Tax Credit before it.
